General Policy

WENDELL WILSON CONSULTING, LLC (doing business as NEXT LEVEL DEVELOPMENT) works as an independent contractor for the Client.   NEXT LEVEL DEVELOPMENT is not considered an employee of the Client.  The Client will send NEXT LEVEL DEVELOPMENT a 1099 at the end of the year.  No other reporting requirements from the Client are required.

NEXT LEVEL DEVELOPMENT sends a bill to the Client at the beginning of each month for any task completed during the previous month.  Unless otherwise agreed, payment is Net 15 upon receipt of the invoice.

Accounts with invoices 60 days and older will be temporarily locked until paid in full or a payment plan is agreed upon with the billing department. No services will be offered to these accounts until they are unlocked.

Accounts with invoices 180 days and older will be deactivated. Any account with web hosting must have their hosting moved within 30 days of deactivation or the site will be deleted. Accounts may be reactivated only upon payment in full and a monthly retainer setup with the billing department. Accounts reestablished after being deactivated will be treated as a new Client and subject to the new Client rate.

Hardware purchased through NEXT LEVEL DEVELOPMENT may require prepayment; this is at the discretion of the billing department. Any hardware provided by NEXT LEVEL DEVELOPMENT is considered property of Wendell Wilson Consulting until it has been paid for in full.

Accounts must be paid in full unless a payment plan has been approved with our billing department.

The Client may terminate NEXT LEVEL DEVELOPMENT services by giving 30-day notice by email to  NEXT LEVEL DEVELOPMENT will complete any pre-paid tasks and will set up an end date for any subscriptions. NEXT LEVEL DEVELOPMENT will provide the client with an Exit Packet, detailing any particular notes that may be necessary for future contractors of the client. 

NEXT LEVEL DEVELOPMENT , employees, agents, sub-contractors, are under a duty not to disclose information, however insignificant, about the Client or its work, trade secrets, and confidential information   to any third party. 

Client shall not solicit any employees, sub-contractors or agents from NEXT LEVEL DEVELOPMENT for employment of any kind with Client, which shall include, but shall not be limited to, performing work as an independent contractor for Client, without the express written permission from NEXT LEVEL DEVELOPMENT .  Client acknowledges that any breach of this paragraph will cause great and irreparable harm to NEXT LEVEL DEVELOPMENT and that the harm could not, in many instances, be adequately or reasonably quantified in terms of monetary damages. Accordingly, Client agrees that NEXT LEVEL DEVELOPMENT shall have the right to obtain temporary and permanent injunctive relief against Client prohibiting any further breach of this paragraph, in addition to whatever other rights NEXT LEVEL DEVELOPMENT may have, upon the occurrence of a breach by Client.

LIMITATION OF DAMAGES:  NEXT LEVEL DEVELOPMENT and the Client agree that the damages from a breach of this agreement are limited to the amount of the fee paid by the Client. If a disagreement occurs sufficient to require a revocation of this agreement, NEXT LEVEL DEVELOPMENT will claim no more that the amount of the fee due from the Client and the Client will claim no more than the amount of the fee paid. Both NEXT LEVEL DEVELOPMENT and the Client agree that a higher fee was not placed in this agreement in exchange for an agreement that neither party would be responsible for the other’s consequential damages.  Both parties agree to submit any irreconcilable conflict first to a mediator, agreeable to both parties, to avoid the time and expense of litigation.

NEXT LEVEL DEVELOPMENT is committed to developing long lasting relationships based on trust. As such, NEXT LEVEL DEVELOPMENT will do everything in its power to ensure that your right to privacy is maintained and protected. Our Services are not directed at children under 13 years of age.


NEXT LEVEL DEVELOPMENT may request or collect personal information from online users in a variety of ways, including through online forms for ordering products and services, and other instances where users are invited to volunteer such information.

Like most standard websites, we use log files. This information may include Internet protocol (IP) addresses, browser type, Internet service provider (ISP), referring/exit pages, platform type, date/time stamp, and number of clicks to analyze trends, administer the site, track user’s movement in the aggregate, and gather broad demographic information for aggregate use. However, none of the information stored in our log files, including but not limited to IP addresses, is linked to personally identifiable information.


NEXT LEVEL DEVELOPMENT may use the personally identifiable information collected by NEXT LEVEL DEVELOPMENT to contact customers regarding products and services offered by NEXT LEVEL DEVELOPMENT and, to the extent the User has agreed to it, by its trusted affiliates, independent contractors and business partners. We may also use this information for research purposes regarding the effectiveness of our Services and marketing and sales efforts. NEXT LEVEL DEVELOPMENT will not in any way share this information with a third party either for free or by selling it, unless you specifically authorize such disclosures.


NEXT LEVEL DEVELOPMENT may also disclose aggregate, anonymous, data based on information collected from Users to investors and potential partners. In such cases, statistical information only will be disclosed, and personally identifiable data will be kept strictly confidential. In case NEXT LEVEL DEVELOPMENT is sold, the information collected from users may be transferred to the new owners.

NEXT LEVEL DEVELOPMENT may from time to time engage third parties, including its own subsidiaries and affiliated companies, to preserve, analyze or otherwise store or manipulate data received by NEXT LEVEL DEVELOPMENT from its customers. In all such cases, such third-party service providers will be required to treat all such data with the same degree of care as NEXT LEVEL DEVELOPMENT and they will be prohibited from disclosing such data to any other person or party, except as otherwise provided for in this Privacy Policy.


Our customers and users will occasionally receive information on products, services, special deals, and possibly a newsletter. Out of respect for the privacy of our users we present the option to not receive these types of communications.


On rare occasions it is necessary to send out a strictly service-related announcement, if, for instance, our service is temporarily suspended for maintenance. Generally, users may not opt-out of these communications, though they can deactivate their account. However, these communications are not promotional in nature.


Though we make every effort to preserve your privacy, we may need to disclose personal information when required by law, if we have a good-faith belief that such action is necessary and required to comply with a current judicial proceeding, a court order or legal process served on NEXT LEVEL DEVELOPMENT .
